The Fair Labor Standards Act (FLSA) of 1938 regulates child labor maximum hours, the federal minimum wage, and extra time provisions. Exempt employees are defined as those whose jobs are executive, administrative, professional, as well as outside salespersons, and computer employees.

Based on this law, as a nonexempt employee I would be entitled to overtime for any week in which I worked over forty hours. Therefore, for the above mentioned scenario, I would be entitled to overtime during the depression and second week but not the third and fourth week. I would be entitled to a 5 hours of overtime pay for the first week and 2 hours of overtime pay for the second week. For a total of seven hours to be paid at a rate of 1.5 times my regular pay.
